At CELLER LA VINYETA, S.L. (“CELLER LA VINYETA”) we work to offer you the best possible experience through our products and services. Sometimes we need to collect information to do so. We care about your privacy and believe we must be transparent about it.
Therefore, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “GDPR”) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and Spanish Law 34/2002 of 11 July on information society services and e-commerce (the “LSSI”), CELLER LA VINYETA informs users that, as data controller, it will include personal data provided by users in an automated file.

Personal data the user may provide:
- Name, address and date of birth.
- Phone number and email address.
- Location.
- Information relating to payments and refunds.
- IP address, date and time you accessed our services, browser used and data about your device’s operating system.
- CV data from job applicants.
- Any other information or data you choose to share with us.
In some cases, completing the registration form is required to access and use certain services on the website; failure to provide the requested personal data or to accept this data protection policy means you cannot subscribe, register or take part in any promotion that requests personal data.
At CELLER LA VINYETA we process information provided by data subjects for the following purposes:
- Managing the contracting of any of our services, whether online or at our premises.
- Managing the sending of information you request from us.
- Managing data submitted by job applicants via their CV solely to carry out the recruitment process.
- Carrying out commercial activities and maintaining and managing the relationship with the user, including services offered through the website and information tasks, which may include automated assessments, profiling and customer segmentation to personalise processing according to their characteristics and needs and improve the online customer experience.
- Developing and managing competitions, prize draws or other promotional activities that may be organised.
- In some cases it will be necessary to provide information to authorities or third-party companies for audit reasons, and to handle personal data in invoices, contracts and documents to respond to customer or public administration claims.
Personal data obtained as a result of your registration as a user will form part of the Record of Processing Activities (ROPA), which will be updated periodically as required by the GDPR.
Processing of your data may be based on the following lawful bases:
- Consent of the data subject for contact forms, information requests or newsletter sign-up.
- Performance of a contract for the purchase of services and products or recruitment in an employment context.
- Legitimate interest in processing customer data for direct marketing and express consent of the data subject for automated assessments and profiling.
- Compliance with legal obligations for fraud prevention, communication with public authorities and third-party claims.
Processing for the purposes described will be kept for as long as necessary to fulfil the purpose for which the data were collected (for example, for the duration of the commercial relationship), and to comply with legal obligations arising from the processing.
CVs from unsuccessful job applicants will be kept for one year from receipt.
In some cases, only when necessary, CELLER LA VINYETA will provide user data to third parties. However, data will never be sold. External service providers (for example, payment providers) that work with CELLER LA VINYETA may use the data to provide the relevant services; they will not use the information for their own purposes or transfer it to others.
CELLER LA VINYETA seeks to ensure the security of personal data when it is sent outside the company and ensures that third-party service providers respect confidentiality and have appropriate measures to protect personal data. These third parties are obliged to ensure that information is processed in accordance with data protection law.
In some cases, the law may require disclosure of personal data to public bodies or other parties; only the minimum strictly necessary to comply with those legal obligations will be disclosed.
Personal data obtained may also be shared with other companies in the group.
CV data from job applicants may be shared with companies specialised in recruitment processes and profile analysis.
In general, data are stored within the EU. Where data are sent to third parties outside the EU, we will ensure they offer an adequate level of protection, for example through Binding Corporate Rules (BCR) or adherence to the relevant adequacy mechanism in force at the time.

Under the GDPR you may request:
- Right of access: you may ask what personal data we hold about you.
- Right to rectification: you may notify us of any changes to your personal data.
- Right to erasure (“right to be forgotten”): you may request deletion of your personal data, subject to prior blocking where required by law.
- Right to restriction of processing: restriction of processing of your personal data.
- Right to object: you may withdraw consent to processing or object to further processing.
- Right to data portability: in some cases, you may request a copy of your personal data in a structured, commonly used, machine-readable format for transmission to another controller.
- Right not to be subject to solely automated decisions: you may request that decisions with legal or similarly significant effects not be based solely on automated processing, including profiling.
In some cases we may refuse a request to delete data that must be kept to comply with legal obligations.
If you have any complaint about how we process your data, you may lodge a complaint with the competent data protection authority.
The user is solely responsible for the truthfulness and accuracy of the data provided, and holds CELLER LA VINYETA harmless in this regard. Users warrant and are in any case responsible for the accuracy, currency and authenticity of the personal data provided, and undertake to keep them properly updated. The user agrees to provide complete and correct information on registration or subscription forms. CELLER LA VINYETA reserves the right to terminate services contracted with users if the data provided are false, incomplete, inaccurate or not up to date.
CELLER LA VINYETA is not responsible for the truthfulness of information not produced by it and where another source is indicated, nor does it accept liability for hypothetical damage arising from use of such information.
CELLER LA VINYETA reserves the right to update, modify or delete information contained on its web pages and may even restrict or deny access to such information. CELLER LA VINYETA is released from liability for any damage the user may suffer as a result of errors, defects or omissions in information provided by CELLER LA VINYETA when it comes from external sources.
The user also certifies that they are over 14 years of age and have the legal capacity necessary to give consent to the processing of their personal data.
Our services are not specifically aimed at minors. However, if any service is directed at children under 14, in accordance with Article 8 of the GDPR and Article 7 of Spanish Organic Law 3/2018 of 5 December (LOPDGDD), CELLER LA VINYETA will require valid, free, unambiguous, specific and informed consent from legal guardians to process minors’ personal data. In that case, ID or other identification of the person giving consent will be required.
For users over 14, processing may proceed with the user’s consent, except where the law requires parental authority or guardianship.
CELLER LA VINYETA has adopted the levels of security for personal data required by law and seeks to implement further technical measures within its reach to prevent loss, misuse, alteration, unauthorised access and theft of personal data provided to CELLER LA VINYETA.
CELLER LA VINYETA is not liable for hypothetical damage arising from interference, omissions, interruptions, computer viruses, telephone faults or disconnections in the operation of this electronic system due to causes beyond CELLER LA VINYETA; delays or blocks in use of this electronic system caused by deficiencies or overloads on telephone lines, overloads at data processing centres, the Internet or other electronic systems; or damage caused by third parties through unlawful intrusions beyond CELLER LA VINYETA’s control.
